Phá Dỡ – San Lấp Mặt BằngUBND cấp xã cấp giấy phép xây dựng cho công trình cấp III, cấp IV, công trình nhà ở riêng lẻ của hộ gia đình, cá nhân trên địa bàn quản lý.
Chính phủ vừa ban hành Nghị định 217 quy định chi tiết một số điều của luật Xây dựng về quản lý hoạt động xây dựng; trong đó, quy định rõ điều kiện cấp giấy phép xây dựng. Nghị định có hiệu lực từ 1.7.
Nghị định quy định việc cấp phép xây dựng phải tuân thủ quy định về điều kiện để cấp giấy phép xây dựng, phù hợp với mục đích sử dụng đất theo quy định của pháp luật.
Thiết kế xây dựng tại hồ sơ đề nghị cấp giấy phép xây dựng với các công trình thuộc dự án đầu tư xây dựng; công trình nhà ở riêng lẻ của hộ gia đình, cá nhân; công trình phục vụ trực tiếp sản xuất nông nghiệp…
Điều kiện chung cấp giấy phép xây dựng có thời hạn gồm: các công trình thuộc khu vực có quy hoạch theo pháp luật về quy hoạch đô thị và nông thôn hoặc quy hoạch ngành hoặc quy hoạch chi tiết ngành được cơ quan nhà nước có thẩm quyền phê duyệt, công bố nhưng chưa thực hiện và chưa có quyết định thu hồi đất của cơ quan nhà nước có thẩm quyền.
Công trình phải phù hợp với quy mô, thời hạn tồn tại của công trình do UBND cấp tỉnh quy định; phù hợp mục đích sử dụng đất được xác định tại giấy tờ hợp pháp về đất đai của chủ đầu tư đề nghị cấp giấy phép xây dựng có thời hạn…
Khi hết thời hạn tồn tại của công trình ghi trong giấy phép xây dựng có thời hạn và cơ quan có thẩm quyền có quyết định thu hồi đất, chủ đầu tư cam kết tự phá dỡ công trình, nếu không tự phá dỡ thì bị cưỡng chế và chịu mọi chi phí cho việc phá dỡ. Việc bồi thường, hỗ trợ, tái định cư khi thu hồi đất, phá dỡ công trình thực hiện theo quy định của pháp luật về đất đai…
Nghị định quy định UBND cấp xã cấp giấy phép xây dựng cho công trình cấp III, cấp IV, công trình nhà ở riêng lẻ của hộ gia đình, cá nhân trên địa bàn do mình quản lý (trừ các công trình quy định tại các khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế).
Ban quản lý khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế cấp giấy phép xây dựng cho các công trình được đầu tư xây dựng tại các khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế trong phạm vi được giao quản lý.
Sở Xây dựng cấp giấy phép xây dựng cho các công trình trên địa bàn tỉnh không thuộc đối tượng quy định ở trên.
Ngoài ra, cơ quan có thẩm quyền cấp giấy phép xây dựng là cơ quan có thẩm quyền điều chỉnh, gia hạn, cấp lại, thu hồi và huỷ giấy phép xây dựng do mình cấp. Trường hợp cơ quan có thẩm quyền cấp giấy phép xây dựng không thu hồi giấy phép xây dựng đã cấp không đúng quy định thì Chủ tịch UBND cấp tỉnh trực tiếp quyết định thu hồi giấy phép xây dựng.
Các trường hợp bị thu hồi, hủy giấy phép xây dựng gồm: giấy phép xây dựng được cấp không đúng quy định của pháp luật. Chủ đầu tư không khắc phục việc xây dựng sai với giấy phép xây dựng trong thời hạn ghi trong văn bản xử lý vi phạm theo yêu cầu của cơ quan có thẩm quyền.
