Ngày 18/8, Bộ trưởng Bộ Xây dựng Trần Hồng Minh đã ký văn bản số 12974/BXD-KTQLXD, gửi các bộ, ngành, địa phương về việc nâng cao hiệu quả công tác quản lý hoạt động xây dựng.

Theo Bộ Xây dựng, thời gian qua, công tác quản lý hoạt động xây dựng, nhất là đối với các dự án quan trọng quốc gia, dự án trọng điểm đã có những bước tiến đột phá mạnh mẽ, góp phần nâng cao hiệu lực, hiệu quả quản lý nhà nước và thúc đẩy phát triển kinh tế – xã hội, bảo đảm quốc phòng, an ninh.
Cũng theo Bộ Xây dựng, hiện nay, Quốc hội, Chính phủ, Bộ trưởng các Bộ, Thủ trưởng các cơ quan ngang Bộ và Bộ trưởng Bộ Xây dựng đã ban hành nhiều văn bản quy phạm pháp luật liên quan đến đầu tư xây dựng, từng bước hoàn thiện hệ thống pháp luật, quy định đầy đủ, chặt chẽ về nội dung, trình tự, thủ tục trong hoạt động xây dựng.
Theo đó, cơ chế quản lý đã thực hiện phân cấp triệt để giữa Trung ương và địa phương, phân định rõ trách nhiệm giữa người quyết định đầu tư và chủ đầu tư nhằm nâng cao hiệu lực, hiệu quả quản lý, hạn chế sự chồng chéo trong thực thi nhiệm vụ, tăng cường tính chủ động của địa phương và chủ đầu tư.
Đồng thời tạo nền tảng cho việc sử dụng hiệu quả các nguồn lực đầu tư, đáp ứng yêu cầu phát triển kinh tế – xã hội trong giai đoạn hiện nay.
Việc phân cấp, phân định thẩm quyền này góp phần nâng cao tính tự chủ của chính quyền địa phương, chủ đầu tư và các chủ thể, rút ngắn thời gian giải quyết thủ tục hành chính, đồng thời đảm bảo tính thống nhất trong quản lý nhà nước thông qua cơ chế kiểm tra, giám sát và thanh tra.
Ngoài việc phân cấp và phân định trách nhiệm, pháp luật còn quy định cụ thể quyền, nghĩa vụ và trách nhiệm của từng chủ thể tham gia hoạt động xây dựng, bao gồm cơ quan quản lý nhà nước, người quyết định đầu tư, chủ đầu tư, nhà thầu, đơn vị tư vấn và các tổ chức, cá nhân có liên quan.
Các quy định này tạo cơ sở pháp lý rõ ràng để các chủ thể thực hiện đúng chức năng, nhiệm vụ được giao, đồng thời nâng cao tính minh bạch, trách nhiệm giải trình và hiệu quả quản lý trong toàn bộ quá trình đầu tư.
Chấn chỉnh, khắc phục ngay các tồn tại, hạn chế
Tuy nhiên, qua công tác thanh tra, kiểm toán, kiểm tra việc chấp hành chính sách, pháp luật về đầu tư xây dựng đối với một số dự án lớn, dự án trọng điểm đã được Kiểm toán nhà nước, Thanh tra Chính phủ chỉ ra một số tồn tại, hạn chế trong quá trình tổ chức thực hiện dự án, bao gồm: Trình tự, thủ tục phê duyệt dự án; điều kiện năng lực quản lý dự án; công tác lập, thẩm định, phê duyệt dự toán gói thầu; lựa chọn nhà thầu; quản lý thực hiện hợp đồng (tạm ứng, nghiệm thu, thanh toán…

Bộ Xây dựng đề nghị các bộ, cơ quan ngang Bộ và UBND các tỉnh, thành phố cần tiếp tục tăng cường kỷ luật, kỷ cương, nâng cao năng lực, trách nhiệm của các tổ chức, cá nhân trong quá trình quản lý hoạt động xây dựng.
Đồng thời, chỉ đạo các cơ quan, đơn vị thuộc phạm vi quản lý kịp thời rà soát, chấn chỉnh, khắc phục các tồn tại, hạn chế (nếu có) trong toàn bộ quá trình đầu tư xây dựng, từ giai đoạn chuẩn bị dự án, thực hiện dự án đến nghiệm thu, bàn giao, quyết toán và kết thúc xây dựng.
Trong đó, tập trung rà soát, chấn chỉnh việc tuân thủ quy định của pháp luật về trình tự, thủ tục đầu tư xây dựng, quản lý chi phí đầu tư, công tác lựa chọn nhà thầu, quản lý và thực hiện hợp đồng xây dựng.
Bên cạnh đó, các bộ, cơ quan ngang Bộ và UBND các tỉnh, thành phố cần chỉ đạo các chủ đầu tư, ban quản lý dự án, các tổ chức tư vấn, nhà thầu và các tổ chức, cá nhân có liên quan trong quá trình thực hiện nhiệm vụ được giao nghiên cứu và nghiêm túc thực hiện đầy đủ các quy định của pháp luật trong hoạt động xây dựng, pháp luật về đấu thầu và pháp luật khác có liên quan; chủ động phòng ngừa không để kéo dài, tích tụ thành vi phạm; tăng cường kỷ luật, kỷ cương, xác định rõ trách nhiệm của người đứng đầu trong từng khâu của quá trình hoạt động xây dựng.
